Kreative Konceptionz – Terms & Conditions

1. Payment & Project Commencement

1.1. Proof of payment is required before any consultation appointment, commencement of the project, or training session.
1.2. A deposit of 50–60% is required to begin any project. For projects under R2000, full upfront payment is required.
1.3. The project will be scheduled once payment is received. Urgent work will incur additional fees if prioritized ahead of schedule.
1.4. Final balance is due upon project completion or on receipt of the final invoice.

2. Quotes & Pricing

2.1. All quotes are valid for seven (7) days unless otherwise stated and may be reconfirmed after this period.
2.2. Any additional work outside the original scope will be charged at the standard hourly rate or pre-agreed cost.

3. Client Responsibilities

3.1. No work will begin until all required content, materials, and project specifications are received from the client.
3.2. Delays in providing these materials may affect timelines and result in rescheduling or additional costs.

4. Project Delays & Forfeiture

4.1. If the project is not completed within 1 month due to the client’s delay (missing content, lack of approvals), the deposit will be forfeited.
4.2. Kreative Konceptionz reserves the right to stop work and re-issue a new 50% invoice or impose a surcharge of up to 30% to continue.
4.3. Delays due to client-side issues may also result in invoicing for completed work and rescheduling based on current rates.

5. Urgency & Rescheduling

5.1. Requests for urgent turnaround may incur a rush fee.
5.2. Projects delayed due to client inaction may be removed from the schedule and subject to re-quoting.

6. Revisions & Scope Changes

6.1. A maximum of three (3) design changes is included, unless otherwise agreed.
6.2. Any additional revisions will be charged at the standard hourly rate.
6.3. Any change to the original brief entitles Kreative Konceptionz to adjust timelines and costs accordingly.

7. Project Timelines

7.1. Graphic design elements (logos, flyers, brochures) have a minimum lead time of one (1) week each.
7.2. Standard websites require 2–4 weeks from content submission. E-commerce sites require an additional 2–4 weeks depending on complexity and products.

8. Training & Maintenance

8.1. Clients may request training to maintain their websites. Changes made by the client (or their agents) are at their own risk.
8.2. Kreative Konceptionz is not liable for any issues arising from client-side edits, including functionality loss or data errors.
8.3. Any fixes or restorations due to unauthorized edits will be charged at the standard hourly rate.
8.4. Clients may alternatively retain Kreative Konceptionz for ongoing maintenance and support under a separate agreement.

9. Hosting & Account Suspension

9.1. Hosting is managed by an external provider. One (1) month’s notice is required for cancellation.
9.2. A R100 late payment penalty applies after the due date.
9.3. Accounts unpaid by the 1st of the month will be suspended after two (2) weeks of non-payment and restored only upon full payment.
9.4 Should no payment be received for three (3) consecutive months, Kreative Konceptionz has the right to terminate the hosting account and cancel the domain.

10. Project Completion & Handover

10.1. Clients must respond to project status completion with final edits within five (5) days.
10.2. If no response is received, the project will be deemed complete, and the final invoice will be issued.
10.3. All outstanding payments must be settled before any deliverables (including files or print materials) are handed over.
10.4. Delays due to the client may result in immediate invoicing of the remaining balance.

11. Copyright & Ownership

11.1. All rights to the final deliverables are transferred to the client upon full payment.
11.2. Kreative Konceptionz retains the right to use any work (including drafts) for portfolio, marketing, or educational purposes.
11.3. Client content is assumed to be legally owned or licensed; the client indemnifies Kreative Konceptionz against any infringement claims.

12. Confidentiality

12.1. All proposals and quotes not accepted remain confidential and may not be shared or copied.
12.2. Any project-related materials remain confidential unless released with written consent.

13. Acceptance, Cancellation & Legal Action

13.1. The client agrees not to unreasonably withhold acceptance or payment.
13.2. Cancellation after project commencement results in forfeiture of the deposit and billing for any completed work.
13.3. Any unauthorized use of project materials will result in legal action.
13.4. The client is liable for any legal costs incurred by Kreative Konceptionz to recover payments or enforce these terms.

14. Limitation of Liability & Indemnity

14.1. Kreative Konceptionz shall not be held liable for any errors or omissions once designs have been approved by the client.
14.2. The client indemnifies Kreative Konceptionz against any claims arising from content supplied by the client.
14.3. Total liability shall not exceed the amount paid by the client for the project.

15. Termination of Service

15.1. Kreative Konceptionz may suspend or terminate services in the event of breach, non-payment, or abuse of services.
15.2. In such cases, entitlement to a refund will be at the sole discretion of Kreative Konceptionz.

16. Governing Law

16.1. These terms are governed by the laws of the Republic of South Africa.
16.2. Any disputes will be subject to the exclusive jurisdiction of the South African courts unless otherwise agreed in writing.

17. Divi Theme Licensing & Branding

17.1. Web design projects include use of a licensed premium Divi theme at no additional cost, provided that Kreative Konceptionz branding remains in the website footer.
17.2. If the client redesigns or modifies the website and removes the footer credit, they are required to remove the Divi theme.
17.3. If the client wishes to retain the Divi theme after they have redesigned the website on their own, a monthly plugin licensing fee will apply, to be discussed and agreed upon.

18. International Clients

18.1. All prices listed are for South African clients. International clients (outside South Africa) are subject to a 15% surcharge to cover time zone support, international payment fees, plugin licensing, and additional admin. This includes 3 months of premium theme and plugin updates at no extra cost.

19. Acceptance of Terms

19.1. By approving the quotation and making payment, you confirm that you have read and agreed to these Terms & Conditions.
